1. AGREEMENT TO TERMS
These Terms of Service (the "Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and SCENTWIKI LLC ("Company," "we," "us," or "our"), concerning your access to and use of the https://en.scentwiki.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
We are registered in Delaware, United States, and have our registered office at 131 Continental Dr, Suite 305, Newark, DE 19713.
BY ACCESSING OR USING THE SITE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. IMPORTANT NOTICE: NATURE OF SERVICES AND LIMITATION OF ROLE
You explicitly understand and agree that SCENTWIKI LLC acts solely as a marketing agent, payment processor, and intermediary platform to facilitate your access to products and services. SCENTWIKI LLC does not manufacture, formulate, or physically handle the fragrance raw materials or final products.
All products (perfumes, DIY kits) and scent creation services are manufactured, managed, and overseen by our global headquarters, Moyora (trading as SCENTWIKI Korea), located in the Republic of Korea.
- Responsibility: The Manufacturer (Korea HQ) assumes full responsibility for the quality, safety, ingredients, and regulatory compliance of the products.
- Compliance: All fragrance products are created in strict compliance with the laws of the Republic of Korea and the standards of the International Fragrance Association (IFRA).
BY PURCHASING A PRODUCT OR SERVICE, YOU AGREE THAT ANY CLAIM RELATED TO PRODUCT SAFETY, DEFECTS, CHEMICAL COMPOSITION, ALLERGIC REACTIONS, OR PHYSICAL INJURY MUST BE DIRECTED TO THE MANUFACTURER (KOREA HQ). YOU HEREBY RELEASE SCENTWIKI LLC (US BRANCH) FROM ANY LIABILITY RELATED TO THE PHYSICAL NATURE AND SAFETY OF THE PRODUCTS.
3. USER REPRESENTATIONS
By using the Site, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete;
- You will maintain the accuracy of such information and promptly update such registration information as necessary;
- You have the legal capacity and you agree to comply with these Terms;
- You are not a minor in the jurisdiction in which you reside;
- You will not use the Site for any illegal or unauthorized purpose.
4. MARKETING AND ELECTRONIC COMMUNICATIONS
By creating an account on our Site or subscribing to our services, you explicitly consent to receive newsletters, marketing or promotional materials, and other information we may send. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us directly.
5. PRODUCTS AND DISCLAIMERS
You acknowledge that scent perception is highly subjective and varies by individual, skin chemistry, and environment. Scent notes described on the Site (e.g., "floral," "woody," "citrus") are for informational purposes only. We do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free. We do not offer refunds based on a customer's personal dislike of a scent or claims that the scent does not match the written description.
- Not Medical Advice: Our products are for cosmetic and educational purposes only and are not intended to diagnose, treat, cure, or prevent any disease.
- Allergies: You agree to perform a "patch test" on a small area of skin before full application. We are not liable for any allergic reactions or skin irritation.
- Flammability: Perfume products contain alcohol and are flammable. Keep away from heat and open flames.
Any "Custom Scent" or personalized product created through our services is made specifically for you. Therefore, ALL SALES OF CUSTOM PRODUCTS ARE FINAL AND NON-REFUNDABLE, except in the case of a verified manufacturing defect (e.g., broken bottle).
6. SCENT SERVICES: WORKSHOPS AND ONLINE SESSIONS
- Booking: Reservations are subject to availability and are confirmed only upon payment.
- Cancellation Policy: You must cancel or reschedule at least 48 hours prior to the scheduled session time to receive a full refund. Cancellations made less than 48 hours in advance are non-refundable.
- No-Shows: Failure to attend a scheduled session without prior notice will result in forfeiture of the full session fee.
You acknowledge and agree that Online (Virtual) Scent Services differ significantly from In-Person experiences.
- Sensory Limitation: In an online setting, you cannot physically smell the ingredients in real-time unless a kit has been pre-delivered. The scent creation process relies on your descriptions and our professional expertise.
- Expectation vs. Reality: Due to the lack of immediate olfactory feedback and differences in hardware (screen colors), the final result of an online session may differ from what you imagined.
- Acceptance: By booking an online session, you accept these inherent limitations. We are not liable for claims that the final product does not match your subjective imagination arising from the nature of remote service.
7. PURCHASES AND PAYMENT
We accept various payment methods through Stripe. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees.
8. RETURN AND REFUND POLICY
Please review our Return and Refund Policy posted on the Site prior to making any purchases. All sales are subject to the Return Policy. As stated above, custom-made products are generally non-refundable.
9. PROHIBITED ACTIVITIES
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
10. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCENTWIKI LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS.
OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
12. DISPUTE RESOLUTION AND GOVERNING LAW
Any dispute arising from your use of the website interface, account management, payment processing, or marketing communications shall be governed by the laws of the State of Delaware, and resolved through binding arbitration in Newark, Delaware.
Class Action Waiver: You agree that any arbitration shall be conducted in your individual capacity only and not as a class action or other representative action.
Any dispute arising specifically from product defects, chemical safety, manufacturing errors, or personal injury caused by the product shall be governed by the laws of the Republic of Korea. You agree to submit to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea for such specific product-related claims.
13. FORCE MAJEURE
We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, acts of God, pandemics, or war.
14. ARTIFICIAL INTELLIGENCE (AI) GENERATED CONTENT DISCLAIMER
SCENTWIKI (hereinafter "Company") may utilize artificial intelligence (AI) and automation technologies to assist in creating product descriptions, marketing materials, visual images, social media posts, and other content within its services. This is intended to provide users with richer information more quickly.
All content generated by AI is provided for informational purposes only and cannot replace medical, chemical, or professional advice. While the Company makes reasonable efforts to ensure data accuracy, we do not guarantee complete integrity regarding potential errors, omissions, lack of currency, or bias that may occur due to the nature of AI technology.
THE COMPANY SHALL NOT BE HELD LEGALLY RESPONSIBLE FOR ANY TANGIBLE OR INTANGIBLE DAMAGES, BUSINESS DECISIONS, OR DISPUTES WITH THIRD PARTIES ARISING FROM USERS' COMPLETE RELIANCE ON AI-GENERATED CONTENT.
In particular, for sensitive matters such as perfume ingredients or allergy information, you must always verify the official labels from the manufacturer or seek professional advice.
The Company reserves the right to modify, delete, or update AI-generated content at any time without prior notice. By continuing to use this website, you are deemed to have fully understood and agreed to the contents of this disclaimer.
